Anti-Spam Policy

PTSender does not tolerate spam. If we realize one of our clients sends spam, that client’s account is cancelled. If you suspect one of our clients is sending spam, please contact us at abuse@ptsender.com

ISPs and Blacklist administrators can also contact us at abuse@ptsender.com If you receive any unsolicited email from a PTSender client, please click on the cancel link on the bottom of the email, or forward it to abuse@ptsender.com

Policy

Besides agreeing to our Terms and Conditions, the PTSender acceptable use includes the sending of graphic newsletters, booklets, promotions, invitations, press releases, the launch of products and other email campaigns to recipients who solicited that information.

PTSender doesn’t allow the sending of unsolicited commercial emails (UCE) nor the sending of unsolicited mass emails (spam). If the email recipient doesn’t intentionally express, with verifiable evidence, will to receive a certain email, it can be considered UCE or UBE (spam). Deliberate and verifiable permission is (1) written proof, or sent by email, that the recipient solicited the reception of certain emails (2) Electronic proof, such as the time and date of the verified proof that was originated, that the IP address agreed in receiving certain email.

- Emails collected from websites or chain emails.
- Lists bought from a third party.
- Lists borrowed from a third party.
- Lists that belong to another organization.
- Any unsolicited list, even a press release directed to reporters, potential clients, employees or anyone who hasn’t solicited your email.
- Sending emails to discussion groups.

OYou can only import contacts that already are in one of your autoresponders and that have confirmed they wanted to receive your messages.

Besides, you need to have made regular contact with them in the last few months. Old inactive lists, even if obtained properly, cannot be imported.

Even the messages which include a list removal link are considered SPAM if the email recipient hasn’t registered in your page as willing to receive your information.

If you use your list to send publicity or any information as a third party, you must ALWAYS say explicitly that is your company that is sending the email.

Imports are only allowed to double opt-in lists, which means every subscriber receives and email confirming he wants to subscribe your list. If you disrespect this rule, your account will be immediately cancelled, with no return option.

Policy application – what we do to eliminate spam

PTSender reserves the right to monitor all imported lists. This inspection may include a hearing to the clients’ lists, where at least will be solicited: the origin of the list, the age of the list, the policies used in the collection and confirmation of the list.

PTSender users should be able to explicitly and clearly certify that their lists consist of e-mail addresses 100 % opt-in. The failure to provide proof upon request will result in the cancellation of the account.

PTSender oversees the content of emails of its clients and marks messages which use content typically used in unsolicited email. A certain combination of factors may result in a suspension to send email until we can contact the responsible.

PTSender keeps record of IP addresses and the subscription date of each new subscription that happens through our subscription processes.

An unsubscribe link is attached to the bottom of each email sent by PTSender. Any attempt to disable these links will result in the immediate suspension of the client's account. If we notice that a client uses PTSender to send unsolicited e-mail, we reserve the right to cancel the client’s account immediately, without right to reimbursement.

Complaint Procedure

If we suspect your account is being used to send spam or unsolicited mass emails, the sending privileges from your account will be temporarily suspended. To know if you are sending spam or not, we will do the following:

- Review the content of the email in question.
- Review your list, for common patterns in acquired lists.
- Complaint Review.
- Optin proof review of the email address in question.

If it is concluded that you actually sent spam, your account will be cancelled without right to refund.

If it is concluded the complaint was a false-positive (someone who subscribed to your list, but forgot), we will make the link between both parties to reach an appropriate solution. After a proper resolution of the problem, the sending the privileges of your account will be reactivated.

Relations between ISP and Blacklist

We share information about our policies with ISPs and with Blacklist administrators and we are always available to discuss a more efficient use of ways to reduce abuse.
